Article 1. | General

1.1 The General Terms and Conditions of Néarr Bedding apply to all offers, products, orders, agreements, and deliveries of Néarr Bedding. By ordering an item, you agree to these terms and conditions; please read them carefully before placing an order. For questions regarding these terms, please contact us at info@nearr.nl

Article 2. | Agreement and order

2.1 The agreement becomes binding the moment you place your order. Néarr Bedding will process your order after you have paid. Until then, Néarr Bedding remains the full owner of the product(s).

2.2 Once your order has been processed, you will receive a confirmation email confirming that your payment has been accepted, along with the details of your order. If you require an invoice including VAT, please send an email to info@nearr.nl

2.3 All images and specifications are indicative. If a product does not meet your expectations, you may return it (see article 6), but this may not be a reason to file a claim.

Article 3. | Payment and payment methods

3.1 You can choose from the following secure payment methods: iDeal, Bancontact, PayPal, and Credit Card; Mastercard & VISA.

3.2 If Néarr Bedding accidentally displays an incorrect price on the website – and it is clear that it is a mistake – we have the right to adjust it. This applies even if you have already ordered the item.

3.3 All product prices shown on nearr.nl include VAT and shipping costs for deliveries within the European Union.

3.3b (Import duties and customs fees outside the EU): For orders shipped to addresses outside the European Union (such as the United Kingdom and the United States), the prices shown do not include any import duties, local VAT, customs clearance fees, or other import taxes. These additional costs will be charged directly to the recipient by the local customs office or carrier. The buyer, as the importer, is personally responsible for paying these costs.

3.4 All your credit card details such as credit card number, expiration date, etc., are automatically transferred to the payment processor via an encrypted secure system, without Néarr Bedding or others having access to the data. Even for any potential refunds, the full credit card details are not visible. If you pay with Visa or Mastercard, extra protection is provided by special authentication methods (Verified by Visa or Mastercard Secure Code).

Article 4. | Delivery

4.1 Néarr Bedding delivers orders via courier services such as PostNL, DHL, DPD, or equivalents.

4.2 If you have accidentally entered an incorrect delivery address or are not at home when the courier service attempted to deliver the package – and as a result, additional costs are incurred – Néarr Bedding has the right to pass these additional costs on to you.

4.3 Néarr Bedding will ship the order as soon as possible after payment of the agreement. Néarr Bedding always strives to ensure that you receive your order within the estimated delivery time. Should this not be possible for any reason (because an item is temporarily out of stock or postal services are on strike), you will be notified immediately.

4.4 Until delivery, Néarr Bedding bears the responsibility for the order. After delivery, the responsibility transfers to you.

4.5 Please note that the delivery times in Article 5 are estimates. If a product does not arrive by the estimated arrival date, it is not possible to file a claim. However, Néarr Bedding will always do its utmost to ensure your order arrives on time.

Article 5. | Approval period

5.1 Néarr Bedding strives for all customers to be satisfied with their purchase. However, we recommend that you check the quality and quantity within fourteen working days. If something is not correct, please send an email to info@nearr.nl In this case, we will provide you with a return label.

Article 6. | Returns and exchanges

6.1 We hope you will be satisfied with your purchase. If for any reason you are not, you have fourteen days from the date you received your order to return the product.

6.2 Please ensure that your order details (order number, name, address) are included in your return package.

6.3 You can send the package after the return form has been completed and approved. You will receive address details from us.

6.4 The costs and responsibility for the return shipment are for the account of the customer (unless it concerns a defective item).

6.5 If goods are used, unfolded, worn, damaged, washed, or incomplete, we have the right to refuse returned items. The goods must be in the state in which they were received. Once the ribbon has been removed and the product has been unfolded, we will not accept it for return. You may examine the product as you would in a store.

6.6 The refund will take place after receipt and inspection within 14 working days from the day your return package has arrived back at our warehouse.

6.7 Néarr Bedding can only transfer the refund to the account from which the original payment was made.

6.8 (Returning from outside the EU):

For returns from outside the European Union, all shipping costs, customs fees, and any other import levies are for the account of the customer.

When returning, the package must be explicitly marked with the carrier as "Returned Goods" with a reference to the original order number. Any clearance or customs fees charged to Néarr Bedding because the return package was not correctly declared will be deducted from the order amount to be refunded. Import duties and taxes paid by the buyer in the country of destination will not be reimbursed by Néarr Bedding.

Article 7. | Copyright
7.1 All photos and images displayed by Néarr Bedding are protected by copyright. Without written permission from Néarr Bedding, photos and images may not be reproduced or used publicly.

Article 8. | Disputes
8.1 All legal relationships are exclusively governed by Dutch law.

These General Terms and Conditions were last updated and became effective on 01-12-2023.
